1. Introduction

These Terms & Conditions apply to all bookings, classes, courses, workshops, events, studio hire, space hire, co-working bookings, facility hire and activities delivered by Unseen Arts Grimsby C.I.C. ("Unseen Arts", "we", "our" or "us").

By booking an activity, hiring a space, attending an event or participating in any Unseen Arts programme, you agree to these Terms & Conditions.

Our aim is to create a welcoming, inclusive and inspiring environment where everyone can learn, create and connect through the arts. These terms exist to help us maintain a safe, respectful and enjoyable space for everyone.

2. Our values

At Unseen Arts, we believe creativity thrives when people feel safe, respected and welcome. We are committed to providing an inclusive environment for everyone, regardless of age, disability, gender identity, gender expression, sexuality, race, religion, background or experience level.

We expect all participants, visitors, artists, instructors, hirers and partners to contribute to a culture of kindness, curiosity and mutual respect.

We have zero tolerance for discrimination, harassment or harmful behaviour, including but not limited to:

  • Racism

  • Sexism

  • Misogyny

  • Homophobia

  • Biphobia

  • Transphobia

  • Ableism

  • Religious discrimination

  • Bullying or harassment

Anyone behaving in a way that compromises the safety, wellbeing or enjoyment of others may be asked to leave and may be refused future participation. Refunds will not be provided in these circumstances.

3. Bookings

Bookings can be made through our website booking system, Acuity Scheduling, or through other booking methods provided by Unseen Arts.

A booking is confirmed once:

  • Payment has been received (where applicable); and

  • Confirmation has been issued.

Places are subject to availability and are only guaranteed once confirmed.

Studio hire, co-working bookings and facility hire may be subject to separate booking processes or hire agreements in addition to these Terms & Conditions. Where a separate hire agreement exists, it should be read alongside these Terms.

4. Payments

Payment must be made in full at the time of booking unless otherwise stated.

Payments are processed securely through Stripe.

Unseen Arts does not store or have access to your full payment card details.

Prices displayed at the time of booking are the prices applicable to that activity or hire.

We reserve the right to amend prices for future bookings.

5. Cancellations, refunds and transfers

Classes, courses and workshops

We understand that circumstances change. If you are unable to attend, please let us know as soon as possible.

For cancellations made more than 48 hours before the scheduled activity, we may offer a transfer, credit or refund at our discretion.

For cancellations made within 48 hours of the scheduled activity, no refund, credit or transfer will be provided.

This policy exists because places are limited and late cancellations often prevent others from attending.

Studio and Room Hire

All studio and room hire bookings are non-refundable. Cancellations made more than 7 days before the hire date may be eligible for a transfer or credit at Unseen Arts' discretion. Cancellations made within 7 days of the hire date are not eligible for a refund, transfer or credit. If we are able to rebook the space for the same date and time, we may, at our discretion, offer a refund, transfer or credit.

Co-Working

Day passes and co-working bookings may be cancelled up to 48 hours before the booking for a transfer or credit. Cancellations made within 24 hours are non-refundable. Membership cancellations are subject to the terms of the relevant membership agreement.

Event tickets

Unless an event is cancelled by Unseen Arts, tickets are non-refundable.

If an event is cancelled or significantly changed by Unseen Arts, participants will be contacted and appropriate options will be provided.

6. Missed sessions

If you are unable to attend a booked class, course session or workshop, please let us know in advance where possible.

Missed sessions cannot be refunded or rearranged.

For multi-session courses, missed sessions do not automatically transfer to alternative dates unless agreed by Unseen Arts.

7. Physical activity, aerial arts and movement classes

Some Unseen Arts activities involve physical movement, including:

  • Aerial hoop

  • Aerial silks

  • Pole

  • Dance

  • Performance

  • Other movement-based activities

Participants acknowledge that physical activities involve an element of risk, including the possibility of injury.

Our instructors are trained to provide safe guidance and participants must follow all safety instructions at all times.

Guidance on appropriate clothing and equipment will be provided at the time of booking for relevant classes. For pole classes, appropriate skin contact is required for grip and safety — detailed guidance will be provided before your first session. The use of grip aids or chalk may be permitted at the instructor's discretion.

Participants agree to:

  • Follow instructor guidance at all times.

  • Use equipment appropriately.

  • Inform instructors of any concerns before or during a session.

  • Avoid attempting movements outside their ability level.

  • Respect their own physical limits.

Unseen Arts reserves the right to modify activities, restrict participation or advise that a participant does not attempt a particular activity where safety concerns exist.

8. Health questionnaires

Participants taking part in physical activities may be required to complete a health questionnaire before attending.

For aerial, pole and other relevant movement classes, completion of a health questionnaire is mandatory.

The purpose of this questionnaire is to help us:

  • Understand any relevant health considerations.

  • Make appropriate adjustments.

  • Support safe participation.

Health information is treated confidentially and access is restricted to:

  • The relevant instructor where necessary for participant safety.

  • Unseen Arts senior leadership where required for operational, safeguarding or legal purposes.

Participants are responsible for informing Unseen Arts if their health changes after completing a questionnaire.

Failure to provide relevant health information may result in participation being refused where safety concerns exist.
In the event of an accident or medical emergency, Unseen Arts will take reasonable steps to assist, which may include contacting emergency services, providing first aid where appropriately trained personnel are available, and notifying the participant's emergency contact where appropriate.

9. Late arrival policy

For health and safety reasons, participants attending physical activity classes must arrive on time.

If you arrive more than five minutes late, or after the warm-up has finished, you may not be permitted to join the session.

This decision rests with the instructor and is made to protect both your safety and the safety of other participants.

No refund will be provided in these circumstances.

10. Instructor changes

Unseen Arts reserves the right to change instructors where necessary. This may happen due to:

  • Illness

  • Availability

  • Professional commitments

  • Operational requirements

We will make reasonable efforts to notify participants where changes occur. An instructor change does not automatically entitle participants to a refund.

11. Class cancellations by Unseen Arts

Occasionally, Unseen Arts may need to cancel a class, course, workshop or event. Reasons may include:

  • Instructor availability

  • Low attendance

  • Health and safety concerns

  • Building issues

  • Circumstances outside our control

Where Unseen Arts cancels an activity, participants will be notified by email or text message where appropriate.

Participants will be entitled to:

  • A full refund; or

  • An alternative date where available and agreed.

12. Accessibility and adjustments

Unseen Arts is committed to making our activities as accessible as reasonably possible.

If you require adjustments to participate, please contact us before booking or attending so we have time to understand your needs and prepare any appropriate support.

We can often adapt activities, environments or teaching approaches to support different access needs.

Some activities involving physical movement may require additional safety considerations, but we will always work with participants to explore suitable options wherever possible.

13. Arts café and events space

Unseen Arts operates an arts café with a stage and performance space. The café is open to the public and is also used to host events, performances and community activities.

All visitors to the arts café are expected to follow our community standards as set out in Section 19 of these Terms.

Some events held in the arts café or events space may be ticketed and subject to separate event terms communicated at the time of booking.

Age restrictions may apply to certain evening events. Where age restrictions apply, these will be clearly communicated in advance.

Photography policy at public events hosted in the arts café or events space may differ from our general class photography policy and will be communicated at individual events.

Unseen Arts reserves the right to refuse entry or remove individuals from the café or events space where behaviour does not meet our community standards.

While we take reasonable care, we cannot guarantee that food prepared or served on the premises is free from allergens.

14. Visual arts studio hire

Unseen Arts offers visual arts studios available for hire by individual artists, creatives and organisations.

Studio hire is subject to availability and must be booked in advance.

Hirers are responsible for:

  • Leaving the studio in a clean and tidy condition.

  • Using the space and any provided equipment safely and responsibly.

  • Reporting any damage, faults or concerns to Unseen Arts staff promptly.

  • Ensuring that any guests or collaborators they bring into the space also comply with these Terms.

Hirers must have appropriate public liability insurance where required for their activity. Unseen Arts may request evidence of insurance prior to hire.

Hirers may not sublet the studio or allow third parties to use the space without prior written agreement from Unseen Arts.

Access to studios is limited to agreed hire periods. Out-of-hours access arrangements must be agreed in advance.

Unseen Arts is not responsible for personal equipment, materials or artwork brought into the studio by hirers. We recommend that hirers arrange appropriate insurance for their own belongings.

Cancellation of studio hire is subject to the cancellation terms in Section 5 of these Terms.

15. Creative co-working space

Unseen Arts offers a creative co-working space available for individual and group bookings.

Co-working bookings are subject to availability and must be made through our standard booking process.

Co-working users agree to:

  • Respect other users sharing the space.

  • Keep noise to a level that does not disturb others.

  • Leave their workspace tidy at the end of each session.

  • Not monopolise shared resources, equipment or furniture.

Guests may be brought into the co-working space with prior agreement. Hirers are responsible for ensuring their guests comply with these Terms and our community standards.

Details of what is included in a co-working booking, such as WiFi, printing or equipment access, will be communicated at the time of booking.

Unseen Arts is not responsible for personal belongings, equipment or data left in the co-working space. Users are encouraged not to leave valuables unattended.

Storage of personal belongings between visits cannot be guaranteed unless a specific arrangement has been agreed with Unseen Arts.

Cancellation of co-working bookings is subject to the cancellation terms in Section 5 of these Terms.

16. Facility hire

Unseen Arts offers facility hire for external individuals and organisations, including the use of our spaces for events, workshops, rehearsals and other activities.

Facility hire enquiries should be made directly to Unseen Arts. Hire is subject to availability and the agreement of a hire arrangement.

Hirers are responsible for:

  • The behaviour and safety of all guests and attendees during the hire period.

  • Leaving the space clean, tidy and in good condition.

  • Complying with any specific conditions attached to the hire arrangement.

  • Obtaining any necessary licences or permissions for their planned activity.

Hirers must hold appropriate public liability insurance for their event or activity. Evidence of insurance will be required before hire is confirmed.

Unseen Arts reserves the right to refuse or terminate a hire arrangement where:

  • The planned activity conflicts with our values or community standards.

  • Behaviour during hire does not meet expected standards.

  • Safety concerns arise.

Cancellation of facility hire is subject to the cancellation terms in Section 5 of these Terms. Additional terms may be set out in a separate hire agreement.

17. Children and young people

Unseen Arts welcomes children and young people across a range of activities.

Where a participant is under 18:

  • Bookings must be made by a parent or legal guardian.

  • Required consent forms must be completed before participation.

  • Parents and guardians are responsible for providing accurate information.

Parents and guardians must ensure that:

  • Emergency contact details are correct.

  • Relevant health information has been provided.

  • Any required consent forms have been completed.

Unseen Arts reserves the right to refuse participation where required information has not been provided.

18. Safeguarding

Unseen Arts is committed to creating safe environments for children, young people and vulnerable participants.

We take safeguarding seriously and have appropriate policies and procedures in place to support the wellbeing of everyone who engages with our activities.

We reserve the right to:

  • Take action where safeguarding concerns arise.

  • Share information with appropriate safeguarding authorities where required.

  • Refuse participation where we believe it is necessary to protect the safety or wellbeing of an individual or others.

Parents and guardians are responsible for ensuring that information provided about a child or young person is accurate and up to date. Our full Safeguarding Policy is available on request.

19. Supervision of children and young people

Unless specifically stated otherwise, parents and guardians remain responsible for children before and after activities.

Parents and guardians should ensure that children:

  • Arrive and are collected at the agreed times.

  • Have appropriate clothing and equipment.

  • Understand expected behaviour during activities.

Unseen Arts will provide appropriate supervision during scheduled activities, but cannot accept responsibility for children outside the agreed activity period.

Where children are participating in performances, exhibitions or events, additional arrangements and consent requirements may apply.

20. Photography, filming and promotional materials

At Unseen Arts, we love celebrating creativity and sharing the work of our participants, artists and community. Photography and filming help us document activities, celebrate achievements and showcase the impact of our work.

However, we also recognise the importance of privacy, consent and protecting the creative work of our instructors and artists.

Photography and filming during classes and workshops

Photography and filming during classes, courses and workshops is only permitted where the instructor has given permission and it takes place at appropriate times identified by the instructor.

Continuous filming of classes, workshops or teaching sessions is not permitted. This includes recording full classes or sessions, instructor demonstrations, choreography or sequences taught within a class, or teaching content for future use.

Teaching approaches, choreography, workshop content and creative materials developed by Unseen Arts instructors and artists remain the intellectual property of those creators and Unseen Arts. Participants must not record, reproduce, share or distribute teaching content without prior permission.

Respecting other participants

Participants must not photograph or film another person without their permission. Please be aware that some people may not wish to appear in photographs or recordings, and everyone has a right to participate in a space where their privacy is respected.

Photography and filming by Unseen Arts

Photography and filming may take place during classes, courses, workshops, performances, exhibitions, community projects and public events. Images and recordings may be used for promoting future activities, sharing news and updates, celebrating participant achievements, funding reports and evaluation, and archiving Unseen Arts activity.

Where appropriate, participants will be informed when photography or filming is taking place.

Arts café and events space

Photography policy at public events held in the arts café or events space may differ from our general class photography policy. Specific guidance will be communicated at individual events. By attending a public event, you acknowledge that audience photography or filming may take place.

Children and young people

For participants under 18, appropriate parent or guardian consent will be obtained before photographs or recordings are used publicly. We take additional care when photographing or filming children and young people.

Withdrawing consent

If you have provided consent for Unseen Arts to use your image or recording and wish to withdraw that consent, please contact us. We will stop using your image in future materials where reasonably possible. However, we may not be able to remove content that has already been published, printed or distributed.

21. Performance participation and consent

Some Unseen Arts activities may include opportunities to perform publicly, including showcases, exhibitions, demonstrations or community events.

Participation in performances is voluntary unless otherwise agreed.

Where a participant takes part in a performance, they agree to follow rehearsal and safety guidance, understand that performances may involve public audiences, and consent to reasonable documentation of the performance where appropriate.

For participants under 18, parent or guardian consent will be required.

Participants should inform Unseen Arts of any concerns regarding accessibility, confidence, physical requirements or other support needs before participating.

22. Behaviour and community standards

Unseen Arts is committed to creating a welcoming environment where everyone feels safe and respected. Participants, visitors, artists, hirers and staff are expected to:

  • Treat others with kindness and respect.

  • Respect personal boundaries.

  • Follow staff instructions.

  • Use inclusive language.

  • Look after shared spaces and equipment.

Unacceptable behaviour includes discrimination or harassment, bullying or intimidation, aggressive or threatening behaviour, sexual harassment, deliberately unsafe behaviour, damage to property, and behaviour that prevents others from enjoying activities.

Unseen Arts operates a zero-tolerance approach to misogyny, racism, homophobia, transphobia and all forms of discrimination.

Participants and visitors must not attend activities whilst under the influence of alcohol or illegal drugs. Anyone whose behaviour appears impaired or unsafe may be refused participation without refund.

Smoking and vaping are only permitted outdoors. Under no circumstance do we allow smoking/vaping in our venue. You will be asked to leave the premises immediately if we are aware of this.

Where behaviour falls below these standards, we may ask an individual to stop the behaviour, remove someone from an activity or venue, refuse future bookings, or report serious concerns to relevant authorities where appropriate.

Refunds will not normally be provided where participation ends due to unacceptable behaviour.

23. Equipment and facilities

Participants and hirers must use Unseen Arts equipment, facilities and materials responsibly. This includes following safety instructions, using equipment only as instructed, reporting any damage, faults or concerns, and treating shared spaces respectfully.

Participants or hirers may be responsible for costs associated with deliberate damage caused to equipment or property. Normal wear and tear will not be considered the responsibility of participants or hirers.

We have no designated parking spaces at Unseen Arts. Unseen Arts are based on Grimsby Docks and there is adequate free street parking. Vehicles are parked at the owner's risk.

24. Artwork and creative work

Unseen Arts encourages creativity, experimentation and the development of artistic practice.

Unless otherwise agreed, artwork created by participants remains the property of the person who created it. Participants retain ownership of their own creative work.

However, teaching materials, resources and workshop content created by Unseen Arts or its artists remain the intellectual property of Unseen Arts or the relevant creator. Participants may not reproduce or commercially distribute workshop materials without permission.

Unseen Arts may request permission to photograph and share artwork for promotional, educational or archival purposes.

25. Artwork storage and collection

Where participants create artwork during classes, courses or workshops, Unseen Arts may provide temporary storage where possible. Participants are responsible for collecting completed work within the timeframe communicated by Unseen Arts.

Unless otherwise agreed, artwork should be collected within three months of notification that it is ready. Unseen Arts will make reasonable attempts to contact owners of uncollected artwork. After this period, Unseen Arts reserves the right to dispose of, recycle or repurpose uncollected work where necessary.

We are unable to guarantee long-term storage of participant artwork.

Ceramics

Ceramic work requires time for drying and kiln firing before it is ready for collection. Participants will be notified when their work is ready. The three-month collection period begins from the date of that notification, not from the session date.

Unseen Arts takes reasonable care during the firing process. However, participants acknowledge that kiln firing carries an inherent risk of damage or loss, including cracking, glazing issues or kiln faults, which are not within our control. Unseen Arts cannot accept responsibility for damage caused during the firing process.

26. Outreach and community work

Unseen Arts delivers outreach and community activity in a range of external venues and community settings outside of our own building.

Where activity takes place at a partner or community venue, the rules and policies of that venue also apply alongside these Terms & Conditions.

Separate project agreements or terms may apply to funded community programmes and outreach projects. Where this is the case, participants will be informed.

The same community standards and safeguarding commitments set out in these Terms apply to all Unseen Arts activity, regardless of location.

27. Memberships

Memberships at Unsen Arts are available on weekly, monthly, or fixed-term plans. By purchasing a membership, you agree to these terms. Payments will be taken according to the plan selected at checkout (weekly, monthly, or for the agreed membership period). Fixed-term memberships, such as 4-week packages, are valid for the full purchased period and cannot be cancelled before the package end date. 


After the membership period ends, members may choose to renew or purchase a new membership if available. Recurring memberships can be cancelled before the next billing date to prevent further payments. All payments are non-refundable once a membership period has started, unless required by law. Memberships are personal and cannot be transferred or shared. Unseen Arts reserves the right to update membership options, suspend access for misuse, or amend these terms when necessary.

28. Lost property

Unseen Arts is not responsible for personal belongings lost, damaged or stolen while attending our activities, hiring our spaces or visiting our venue.  Personal belongings are brought onto the premises at the owner's risk.

Any property found at our venue will be stored where practical. Participants should contact us if they believe they have lost an item. Unclaimed property may be disposed of after a reasonable period.

29. Intellectual property

All content created by Unseen Arts, including workshop resources, teaching materials, branding, written content, digital resources and creative programmes, remains the property of Unseen Arts or the relevant creator unless otherwise stated.

Participants may use skills and techniques learned through our activities for their own creative development but may not reproduce Unseen Arts courses or materials commercially without permission.

30. Force majeure

Unseen Arts will not be responsible for delays, cancellations or changes caused by circumstances outside our reasonable control. This may include extreme weather, flooding, fire, building damage, power failure, government restrictions, public health emergencies, industrial action or other unforeseen events.

Where possible, we will communicate changes as soon as possible, offer alternative arrangements, and provide refunds where appropriate.

31. Liability

Unseen Arts takes reasonable steps to provide safe, enjoyable and well-managed activities.

Participants are responsible for ensuring they participate appropriately and follow instructions provided by staff and instructors.

For activities involving physical movement, participants acknowledge that some risk is inherent.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.

32. Complaints and feedback

We welcome feedback and want everyone who engages with Unseen Arts to have a positive experience.

33. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, activities or legal requirements. The latest version will always be available on our website.

34. Governing law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes relating to these Terms will be subject to the jurisdiction of the courts of England and Wales.
